Terms of Service

1. Acceptance of Terms

By purchasing a subscription to or using the services of Lixtus Consultancy (“we,” “us,” or “our”), you (“you” or “Subscriber”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. The Service

Lixtus Consultancy provides advertising and lead generation services for real estate professionals. We run targeted advertising campaigns that direct prospective home sellers to a property-valuation landing page. When a homeowner submits their property details, that information is delivered to you as a lead via email and/or a shared Google Sheet.

3. Subscriptions, Billing & Cancellation

Fees are stated at checkout and on our pricing page, and are billed monthly in advance through Stripe. Subscriptions renew automatically each month until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. There are no contracts, no setup fees, and no cancellation fees. You are responsible for keeping your payment method current.

4. No Guarantee of Lead Quantity or Quality

Important: You acknowledge and agree that:

  • The number of leads generated in any month is an estimate only and is NOT guaranteed. Actual results vary based on market conditions, seasonality, competition, advertising platform changes, budget, and other factors outside our control.
  • Lead quality — including the accuracy of contact details, seller motivation, and readiness to transact — is NOT guaranteed. We do not guarantee that any lead will respond to outreach, be genuinely interested in selling, or result in a transaction.
  • Estimated lead counts and “first lead” timeframes are provided for illustrative purposes only and do not constitute a warranty of performance or a guarantee of any particular result.

5. County Exclusivity

County exclusivity is available only on the Dominator plan, on a first-come, first-served basis, and only while your subscription is active and in good standing. Exclusivity means we will not sell the same county to another Dominator subscriber. It does not restrict agents on Starter or Growth plans, nor third parties outside of our service.

6. Refunds

Because our advertising services begin immediately upon signup and involve committed advertising spend, all fees are non-refundable except where required by law.

7. Your Responsibilities

You are responsible for (a) providing accurate and current contact information, (b) holding all necessary real estate licenses and complying with all applicable laws, regulations, and rules — including advertising and fair housing laws — and (c) all communications and dealings with leads.

8. Acceptable Use

You agree not to use leads for any unlawful or deceptive purpose, not to resell or redistribute leads outside your own brokerage or team, and to comply with all applicable laws, including the CAN-SPAM Act and telemarketing regulations.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, or results.

10. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us in the month immediately preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business opportunities.

11. Real Estate & Licensing Disclaimer

Lixtus Consultancy is not a licensed real estate brokerage and does not provide real estate brokerage, valuation, or transaction services. We provide advertising and lead generation services only. Equal Housing Opportunity.

12. Intellectual Property

All content, trademarks, and materials on our website and in the Service are the property of Lixtus Consultancy or its licensors and are protected by applicable laws.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date. Continued use of the Service after any change constitutes your acceptance of the updated Terms.
